Terms and Conditions of Sale (version 1 – 6/2/2026)

These Standard Terms and Conditions apply to every Contract between VOLUPTO Pty Ltd (ABN 38 601 990 327) (“Us/We”) trading as Bellastone and The Customer (“You”), being the purchaser of the Bellastone “Product.” By purchasing our products, you acknowledge and accept these terms in full.

 

1. Product Nature & Variations
  • Natural Variations: You acknowledge that our products are made from natural materials. Variations in colour, texture, grain, and finish are inherent and may differ from samples, brochures, or website images. Samples are provided as a guide only.
  • Manufacturing Tolerances: Due to the manual manufacturing process, final products may vary slightly from reference colours. These variations do not entitle the customer to a refund or remedy.

 

2. Ordering & Customization
  • Custom Orders: Custom-made items or requested variations cannot be returned or cancelled for any reason. Specifications must be verified and confirmed by you before the deposit is paid.
  • Accuracy of Drawings: We rely on measurements and drawings agreed upon with you. No claims will be accepted if the product matches the dimensions/sketches confirmed at the time of order.

3. Payment Terms
  • Deposit: A 50% deposit is required upon placement of the order.
  • Balance: The remaining 50% balance, plus any freight charges, must be paid on or before the day of shipment.


4. Handling & Installation (The "Duty of Care")

Our products are heavy and bulky and may be difficult to handle. Improper handling will void your warranty.
Storage: Products must remain in their original delivery crate until they reach their final installation location.
Movement: Do not rest products at an angle or on their corners. They must remain flat on even surfaces.
Liability: We accept no liability for damage once the original packaging has been disturbed or if the product is handled by unqualified persons.


5. Freight & Delivery
  • Agent Status: We are not a freight company. We act as your agent to secure competitive delivery quotes.
  • Boundary Delivery: Goods are delivered to the property boundary only. Moving the product from the boundary to the building is your responsibility.
  • Attendance: If no one is present to receive the delivery, goods will be returned to the depot at your expense.
  • Risk: All risk and responsibility for the product pass to you immediately upon delivery or collection.

6. Inspection & Claims
  • 48-Hour Inspection: You must inspect the goods and notify us of any damage within 48 hours of delivery to facilitate insurance claims.
  • Proof of Condition: You may be required to sign a consignment note confirming the goods were received in good condition.
  • Access for Inspection: If a claim is made, you must provide us with access to the product (as installed) to diagnose the issue.

7. Storage of Uncollected Goods

Products must be collected or delivered within 2 months of our notification of availability. After this period:

  • Storage fees will apply based on the size of the goods.
  • Items left long-term without prior written agreement will be treated as abandoned without a refund.

8. Warranty & Liability
  • 5-Year Warranty: We provide a 5-year warranty against manufacturing faults or material failure.
  • Exclusions: This warranty does not cover damage caused by poor handling, neglect, misuse, or failure to follow the specific care instructions provided on our website or via email.
  • Limited Liability: Our liability is limited to the product itself. We are not liable for any consequential loss or damage to property arising from the delivery or use of the product.

9. Dispute Resolution & Governing Law
  • Good Faith: In the event of a dispute, both parties agree to meet in good faith to resolve the issue, starting with a detailed written notice of the breach.
  • Jurisdiction: This contract is governed by the laws of New South Wales. Any disputes will be subject to the exclusive jurisdiction of the NSW Courts.
